By accessing The Straight Record ("the Publication"), located at straightrecord.com, you agree to these terms. If you do not agree, do not use the site. The Publication is operated by Brian Louden ("the Publisher"), an independent journalist based in St. Croix, U.S. Virgin Islands.

The Publisher shall have thirty (30) calendar days from receipt of such notice to respond, investigate, and, if appropriate, correct or remove the content. No legal action may be commenced until this 30-day period has expired. Notice shall be sent to tips@viupdate.com with the subject line "Legal Notice."

Contractual Limitations Period

Any claim arising from or related to the Publication or these Terms must be commenced within one (1) year after the cause of action accrues. Claims not brought within this period are permanently barred.

Prevailing Party Attorney's Fees

In any legal proceeding arising from or related to these Terms or the Publication, the prevailing party shall be entitled to recover reasonable attorney's fees and costs from the non-prevailing party.

Indemnification

You agree to indemnify and hold harmless the Publisher from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Publication, your violation of these Terms, or your violation of any rights of another party.

Governing Law

These Terms and any disputes arising from or related to the Publication shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

Venue and Jurisdiction

Any legal action or proceeding arising from or related to these Terms or the Publication shall be brought exclusively in the courts of the U.S. Virgin Islands or the District Court of the Virgin Islands. You consent to the personal jurisdiction of these courts and waive any objection to venue.

Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect.

Changes to These Terms

The Publisher may update these Terms at any time. Changes are effective when posted. The "last updated" date at the top of this page reflects the most recent revision. Continued use of the site after changes are posted constitutes acceptance of the updated Terms.
